Definitions. The following terms will be defined for a better understanding of the terms of use:
This site includes the content displayed on the domains ListaFirme.ro, ListaFirme.eu and their subdomains.
Using this site (visiting, purchasing products) implies full acceptance of the remote contract consisting of these terms and conditions of use.If you do not agree with them or are not at least 16 years old, please stop accessing the site.
Subject of the contract:
Providing online access service, based on access packages, to the ListaFirme.ro database containing data on legal entities in Romania.
When first creating an access account, the user receives, under this contract, an access package with 20 credits valid for an unlimited period, with the option of detailed profile.
User's Obligations:
a. To have the right to set up an access account on this site, the User must be at least 16 years old.
b. The user of the website is obliged to act legally each time he accesses the website or uses the services offered. The user undertakes to:

The User agrees not to hold the Provider liable and not to take legal action against the Provider for any claim raised by a third party resulting from the User's use of the service and the Internet, as well as for any loss (direct, indirect, consequential or otherwise), costs, actions, lawsuits, claims, expenses (including legal costs) or other liabilities, suffered in any way or directly caused by the Provider as a result of the User's breach or disregard of these conditions.
d. The user is obliged to fill in real data and verify personal account data including name, surname, email and mobile phone number at least once every two years.
Download permissions:
a. Service providers whose business or marketing consultancy is their object of activity are permitted to take over data for the purpose of producing reports for their own clients, only with the mention of the source and within the limit of the specific specification of a maximum of 100 companies/report, without the publication of the reports being permitted.
b. Pupils, students and doctoral candidates are allowed to take over and include statistics and data in their own course/diploma/bachelor's/doctoral papers only with the mention of the source and within the limit of specifying a maximum of 100 companies.
c. The publication of any article that includes statistics and/or retrieved data requires the written consent of the Provider, except as provided in point b.
d. Users can access data sets using the export functionalities available on the site. It is strictly forbidden to copy/paste data from company pages into files that, in a month, cumulatively or separately, contain information about more than 1000 companies.
e. Any other permission regarding the downloading of content that is not already specified requires the consent of the Provider.
If for certain services or products the parties have agreed on a different return policy through contractual specifications, the most advantageous option for the user will apply.
Accuracy and completeness of information
The information displayed online or exported has a guaranteed minimum accuracy of 99% for identification information, balance sheet and other official data, in relation to the update date and a minimum of 90% for contact information. The degree of completeness of the information in the selections may differ depending on the criteria applied and can be viewed in the section [Selections] / [Data export]
For exported databases, the supplier guarantees the replacement or refund of the value of data found to be incorrect that does not fall within the minimum guaranteed accuracy percentage, if such deficiencies are reported by detailed report within 30 days from the date of supply. The detailed report will contain the listing of the claimed data and the finding for each one.
Limitation of liability
a. The user expressly declares that he understands and agrees with the following statements:
I. The use of the service is at your own risk. Thus, the Provider cannot be held liable for any direct or indirect damages caused by the use of the site or the websites in connection with it.
II. The provider ensures the proper functioning of the site and the updating of information to the extent that the efforts are not disproportionate to the interest shown by users and does not respond or guarantee that:
- the services meet or will be adapted to any of your requirements;
- the services will be available and functional at all times (there may be short maintenance periods);
- the data presented on the site is fully complete, current and correct (it is the most recent information collected);
- all information provided by the User will be accepted or displayed on the site immediately (they are first validated/verified).
III. The information obtained through the use of the service has a good degree of accuracy, which does not exclude the possibility of possible errors. The user will be the only person responsible for the use and any losses that may result from the use of this information without verification.
IV. No advice or other information, whether oral or written, obtained by the User from the Provider through the service shall create any warranty not expressly stated in the Terms of Use.
b. The Provider's liability (if established by a court or arbitral tribunal) arising in any way from or in connection with the provision of the service under these conditions is limited in the case of each event or in the case of any series of multiple events to 100 Euros.

Offer validity
The prices displayed on the site include a 20% discount and are valid exclusively under the distance selling contractual conditions set out herein and in the standard contracts made available online for certain services. Any proposal to modify the contractual terms cancels the price offer and the discount applied to the prices presented online and is subject to an eligibility analysis.
Payment
Payments can be made through the PayU payment processor if you initiated the order online or directly into the account on the proforma invoice received from the account manager if you initiated the order by phone or email.
Return policy
Complaints and suggestions
Complaints and suggestions are accepted if sent to the email address [email protected] with the identification of the complainant by: name, address, telephone, legal entity identification data (if applicable). These are registered in the Register of Suggestions and Complaints and resolved within 30 days. You can also send complaints to ANPC.
Security
The User acknowledges that the Provider cannot control and does not offer any guarantees regarding the security of information that is transmitted over the Internet.
The provider is not responsible for unauthorized access to user accounts caused by the choice of weak passwords or the user's negligence in maintaining the confidentiality of authentication data.
For reasons of contractual liability and data security, only legal entities can purchase databases with a total value of over 4,000 lei including VAT within a year.

a. The Service may be used by the User to find out various information displayed by the Provider on the WEB, to connect with other websites in the world, and the User undertakes to comply with the usage policies valid in those networks or sites. The User accepts the fact that the Provider does not control these sites, is not responsible and does not assume any obligation regarding other sites, any link from other sites or their content.
b. Any inclusion of links to other sites is made solely for the convenience of the User and does not imply any endorsement by the Provider of the material available on those sites or networks, nor any association with their operators. The User accesses those sites and uses their products and services solely at his own risk.
Intellectual property
The user expressly declares that he/she has acknowledged that the logos and associated symbols used on this site are registered trademarks of Suppliers.
Personal data
By using this site you agree that the Provider has the right to process your personal data, disclosed as a result of using the service, in accordance with GDPR specifications.
Overview
a. Changes to conditions – The Provider may modify these Terms and Conditions from time to time without notice to the User. Such modifications will be brought to the attention of the User by posting them on the website. The modifications made in this way are deemed to be accepted by the User if he continues to use the service after their posting on the website.
b. Force Majeure – The Supplier assumes no responsibility for the inability to comply with the obligations set forth in these conditions as a result of any cause beyond its control, including but not limited to acts of God, adverse weather conditions, the action or inaction of the government or other authorities, or other networks for which the Supplier is not responsible.
c. Jurisdiction – This website (excluding third-party websites to which there are links) is controlled by the Provider. By accessing this website, the User accepts that these conditions and any dispute related to them are governed by and interpreted in accordance with the laws of Romania, and the User agrees to submit to the exclusive jurisdiction of the courts of Romania. This website can be accessed from anywhere in Romania and abroad. The Provider makes no representation that what this website contains is subject to the laws (including intellectual property laws) of other countries outside Romania. If the User accesses this website from outside Romania, he does so at his own risk and is solely responsible for compliance with the laws of the territory in which he is located.
d. Privacy – The Provider does not guarantee that the use of this website will be confidential. The Provider is not responsible for any damage suffered by the User or any other person as a result of a breach of confidentiality regarding the User's use of this website. Any information that the User discloses on the website may not be secure during its transmission over the Internet. Third parties have the ability to intercept the transmissions that the User makes when using this website. Some services that the User accesses on this website allow the Provider to receive personal information.
